Missouri Gov. Blunt Signs Immigration Reform Bill

“A two-year effort to curb illegal immigration in Missouri came to fruition Monday as Gov. Matt Blunt signed legislation designed to catch illegal workers and punish their employers. The bill contains a wide range of new requirements, including mandatory checks on the legal status of all public employees, welfare applicants and criminal suspects whenever they are jailed,” the Kansas City Star reports.

[FAIR’s legal affiliate IRLI, the Immigration Reform Law Institute as well as FAIR activists were involved in making sure that this measure was crafted as well as instrumental in keeping the pressure on to pass it. Kudos to FAIR activists in Missouri for this important victory!]

Five Idiots On the Bench….Or how to turn 4 1/2 months to 10 years

EDITORIAL:

Five idiots just gave the green light to half the illegal aliens in the country this morning! The Supreme Court ruled 5-4 Monday, June 16 that someone who is here illegally may withdraw his voluntarily agreement to depart and continue to try to get approval to remain in the United States. See AP story Just for the record AP, Mr. Dada was a “foreign national” when he arrived in the U.S. but when he overstayed his visa, how do you say “illegal alien”. There is a difference!

So this illegal Nigerian alien, Samson Dada, (see it’s not always the illegal Mexican and South Americans aliens) came into the U.S. on a tourist visa and overstayed when it expired in 1998. So ICE has been screwing with him for 10 years? What’s that all about? Then he married an American citizen the following year and began trying to obtain a visa as an immediate relative of a citizen. Oh, by the way, did I mention that it was a “sham” marriage. Dada and his supposedly wife failed to submit the proper papers, immigration officials denied the visa and ordered him to leave the country. He agreed to leave voluntarily, which would have allowed him to re-enter sooner than if deported. This has been in the process with ICE for 10 years? Again, what’s that all about? (Oh, did I repeat myself?)

Sham marriage? Break the law? No problem with these liberals and they did it at the request of the Bush administration! You can be sure the immigration attorneys will be jumping all over this one! This is just another example of the courts overstepping the Constitution and our laws. They all need to be un-benched permanently. See why electing the right leader in this year’s Presidential election is so important! Then again, we have the choice of a Democrat, Socialist and a Communist so who knows what will happen in either case.

To see how crazy this whole thing plays out for 10 years and how inept our government bureaucracy and legal system is, I’ve taken the liberty to post the following case analysis from Dr. Bill Long, a lawyer, and have high-lighted some important text. Read full text at Dr. Bill Long’s website.

Docket No. 06-1181; Oral Argument Jan. 7, 2008*

“…Let’s tell the story behind the case and see what your inclinations are. I think if you listen to the facts–and especially see the chronology, you might be rather astounded at it all.

…Mr. Samson Dada, a Nigerian citizen, who applied for a nonimmigrant visa to the United States in 1998. …. When a foreign national with a nonimmigrant visa arrives at the US border, s/he is granted a period of time in which s/he can remain in the country. So, Mr. Dada arrived in the US on April 4, 1998 and could stay until August 31, 1998. But, as so often is the case, he overstayed.

At first, no one did anything about it. But in 1999 he decided to marry to a US citizen. She applied for an I-130 visa for her spouse, which was a way to get him to stay (more) permanently in the US. Normally it takes about 990 days–almost three years to adjudicate an I-130 visa petition. What? Why? I have no idea, but someone ought to try to figure this one out.

finally on February 7, 2003, Homeland Security, which didn’t even exist when they applied for an I-130 visa, denied the visa petition and deemed it “abandoned.” Why? Well, they hadn’t furnished all the right documentation to the immigration officials.

By this time, however, he has been in the country nearly five years after his nonimmigrant visa expired. Fear not. We are just beginning. A year later, on January 4, 2004, Homeland Security decided that Dada ought to be removed…. In any case, if he had a removal order, he has some time to maneuver, to appeal, etc. So on March 17, 2004 the wife again decided to file an I-130 visa petition. Why? Well, if it took Homeland Security 3 1/2 years to get to the first one, you might as well try this again.

But the immigration judge (IJ) denied this petition but did allow Dada to request “voluntary departure” in lieu of removal. This is an important point. You can apply for voluntary departure either during or after your removal proceeding. If you are awarded this, the removal proceeding stops (i.e, they won’t come and get you) and you have either up to 120 or 60 days (depending on whether it was during or after the removal proceeding ended) to leave the country. ….

You wonder sometimes if all of this is a joke, but I am a lawyer and lawyers can’t joke. So, let’s continue. After Dada was granted a request for voluntary departure, he decided to appeal his removal to the Board of Immigration Appeals (“BIA”). This stops the clock on departure. So, the BIA got into the act and decided on Nov. 4, 2005 that Samson Dada had to go. The BIA decided that he had exactly 30 days to depart voluntarily. If he didn’t depart in those 30 days, he would be ineligible for status adjustments for 10 years–and face lots of fines and other inconveniences.

Sounds like things are just about over, don’t they? Well, Samson was a strong guy, not only in the Bible but also in this case. On day 28 after this order, he filed a motion with the BIA to “reopen” his case and to “withdraw” his request for voluntary departure. The reason he did the latter was that if he stayed over his 30 day period (i.e., past December 5, 2006), he would lose the benefit of the voluntary departure and tons of bad stuff would happen to him. But by asking the BIA to “reopen” his case, he would have 90 days after the Nov. 4 decision to do so. So, he stayed in the country. On Feb. 8, 2006 the BIA denied his motion to reopen the case. Now he really has to go, right? No, he appealed to the Court of Appeals of the Fifth Circuit, which couldn’t wait to get the case off of its docket, denying him relief in a one-page unpublished decision on Nov. 28, 2006.

All is not lost. So, he appealed to the US Supreme Court on Feb. 26, 2007–the final day he could do so and, guess what, the Supreme Court decided to hear his case. By the time the Court renders a decision, probably in Spring 2008, it will be almost 10 years to the day that Samson Dada was supposed to have left the country. Now can you understand what immigration reform is up against?

EDITORIAL: Is the United Methodist Church running an illegal alien underground railroad in Nebraska?

The Nebraska Observer recently learned that the United Methodist Church at their annual meeting April 23-May 2, in Ft. Worth, TX, adopted resolutions covering both global migration and immigration issues in the United States

The Methodist’s U.S. domestic resolution calls for “full protection of all workers, which includes the opportunity to gain legal status for all migrants.” It also urges U.S. lawmakers to ensure that immigrant laws do not rip apart families.”

Their global resolutionadvocates for the unification of families divided by borders and commends refugee resettlement work of the United Methodist Committee on Relief.”

A revision of the Social Principles replaces a statement on migrant workers with a more global perspective. “We call upon governments and all workers to ensure for foreign workers the same economic, educational and social benefits enjoyed by other citizens,” the new statement says.

So what does this mean for Nebraska MethodistsFirst and foremost, fellow Nebraska Methodists contacted by the Nebraska Observer said “that they did not get the memo from their church on this one!”  Secondly, members are not aware of this vast left-wing/liberal conspiracy by minority members of the Methodist church who are advancing an “open-borders” and unconditional “amnesty” agenda. The third point is the big one.  They are not aware that their church contributions are going to support this illegal and unpatriotic activity.

The liberal CNN authorized a poll by the Opinion Research Corporation, Jan. 14-17, 2008 which indicated that about 65% of Americans would like to see the number of illegal immigrants decreased while about 35% would like to see the numbers increased (5%) or remain the same (30%).  Now if we extrapolate this to the average Methodist church congregation or to the total United Methodist Church membership….Op’s, it looks like a lot of us didn’t vote on that measure in Ft. Worth!

We are a nation of laws. The opposite of laws is pure “anarchy“.  This group of traitors against the American citizenry within the Catholic, Lutheran, Methodist and other denominational faiths would have you believe that we can pick and choose which laws we want to obey.  If a personal conviction dictates that you don’t like the law, you can disobey the law (sounds like the 60’s doesn’t it?).  Here’s what federal immigration law says.

Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):

A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

  • assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or
  • encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or
  • knowingly assists illegal aliens due to personal convictions.

Disregarding those laws which we the citizens have put in place to protect us, these misguided unpatriotic anarchists continue to aid, abet, and pursue human smuggling so illegal aliens can get jobs.  This has created theft, rape, robbery, murder, repeated drunk driving, wage depression and document fraud within our communities. 

Nebraska citizens who NOW cannot comprehend what illegal immigration does only has to look at our FUTURE by studying unfettered illegal immigration results in Arizona, California, , Illinois, New Jersey, New Mexico, North Carolina, Oklahoma, and Texas, for example.  It’s not rocket science folks!

These “liberal” open-borders nuts can’t justify their position based upon facts or logic, so they have to appeal to your emotional side and quote certain bible scripture to fit their actions.

This is the same kind of liberal mumbo-jumbo that the Methodist Church in Nebraska went through several years ago when one church and pastor in particular wanted to perform “same-sex” marriages.  It literally broke that church apart and the outrage from the general membership started to divide other congregations.  Fortunately, this matter was resolved.

Catholics, Lutherans, Methodist and other denominational members should be saying to their priest/pastor and fellow members “Not in my church!…Not in my back yard!”  This group of traitors against U.S. laws and the American citizenry pose a potentially serious danger to the body of any church.  If DHS and the DOJ had any “cahunes”, they’d bust these churches which have become sites for breaking laws.  

So what started this rant in the first place?  The Nebraska Observer noticed this item in a local state newspaper.

She will speak at 8:30 a.m. at the First United Methodist Church in North Bend and at 10:30 a.m. at Christ United Methodist Church in Schuyler.

Keeney is the program manager of Justice for our Neighbors-Nebraska (JFON-NE), a faith-based outreach ministry of the United Methodist Committee on Relief. The mission of the JFON-NE is to welcome immigrants into our churches and communities by providing free legal services, education and advocacy. Volunteer driven clinics are held in Columbus on the last Tuesday of each month.

Justice For Our Neighbors (JFON) is an arm of the General Board of Global Ministries of The United Methodist Church. The mission of JFON is generally to provide free immigration legal services, a warm welcome (their words) and advocacy to immigrants in their congregations and communities.  Notice that JFON is careful not to say above that they are offering these services to illegal aliens.  Instead, they say immigrants. Now we all know that legal immigrants don’t have an urgent need for these services because they are legal.  Could it be that the services they are offering are felonies under Section 274?

Catholic, Lutheran, Methodist and other denominational churches don’t believe immigration agents will make arrests inside their churches but ICE agents have the authority to arrest anyone violating immigration law, anywhere.

This would be a good time for North Bend and Schuyler residents to go and protest the Methodist church aiding and harboring illegal aliens in their community.  Let’s see, you also have a location and the time.  It might also be a good time to call ICE.  Also, notify the Nebraska Minuteman and ask them to protest.

RED ALERT!! – Amnesty Warning – Take Immediate Action!

Sellout Senator’s Dianne Feinstein (D-Calif.) and Larry Craig (R-Idaho) have successfully inserted the “Ag Jobs” amnesty components into a defense spending bill.

This amendment has been accepted by the Senate Appropriations Committee and has been added to an Iraq War spending bill.

They could vote on the spending bill today or tomorrow. If the bill passes with this language included, it will grant a form of AMNESTY to millions of illegal aliens working on farms.

Take immediate action.

1. Call Dianne Feinstein and Larry Craig and give their staff an earful within reason. Follow-up your call with an e-mail or fax.

2. Call both of your US Senators immediately. If you get a voicemail, leave a message. Tell your Senators NO AG JOBS AMNESTY! NO DEFENSE SPENDING BILL WITH AG JOBS IN IT! Make sure you call, and immediately send a written complaint after calling.

3. Then proceed to call as many other members of the US Senate as possible with the same message. Call them all if you can.

We need a strong and immediate reaction from across the nation to this move by Feinstein and Craig!
