011708 Boy who fled with teacher receives Mexican passport

Fernando Rodriguez has been issued a Mexican passport that should eliminate any doubt that he was 13 years old at the time 25-year-old Lexington teacher Kelsey Peterson fled with him to Mexico, his lawyer said Wednesday.

Omaha Attorney Amy Peck said the passport also will be needed if the youth, who was in the United States illegally, is granted special permission to return to the U.S. from Mexico.

Peck is working to bring Fernando back to Nebraska, where his mother and two U.S.-born brothers live. The passport, which is based on a birth certificate and other documents provided to the Mexican government by Fernando’s mother, show that he turned 14 Wednesday.

Peterson remains in jail facing a federal charge of taking Fernando across the border to engage in sexual activity, which carries a sentence of 10 years to life in prison, as well as state felony charges of kidnapping and child abuse.
